These Terms and Conditions govern the provision of waste collection services offered by Waste Collection Marylebone. By booking or using our waste clearance or collection services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking or allowing us to carry out any services at your premises.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, landlord, managing agent or organisation that makes a booking or otherwise contracts with us for waste collection services.
Services means the waste collection, removal, clearance, recycling, or related services we agree to provide to the Customer.
Waste means any items, materials, rubbish or refuse that the Customer requests us to remove, including household, commercial, office and garden waste, subject to any exclusions in these Terms and Conditions.
Site means the property, premises or location where the Services are to be carried out.
We, us, our means the waste collection service provider trading as Waste Collection Marylebone.
2. Scope of Services
We provide waste collection and removal services within Marylebone and surrounding areas, including but not limited to domestic waste removal, office clearance waste, bulky item collection and non-hazardous commercial waste collection. The specific Services to be provided will be confirmed at the time of booking and in our written or electronic confirmation.
We reserve the right to refuse the collection of any waste that we reasonably believe to be hazardous, prohibited, illegally stored, contaminated, inadequately described, or outside the scope of our licence or capabilities. We may also refuse collection where there is a risk to health and safety, or where access to the Site is unsafe or significantly obstructed.
3. Booking Process
3.1 Bookings for waste collection services may be made by telephone or by electronic communication. At the time of booking, the Customer must provide accurate details of the type and approximate volume of waste, the location of the Site, any access restrictions, and preferred dates and times for collection.
3.2 Any quotation provided prior to visiting the Site will be based on the information supplied by the Customer. All quotations are estimates only and may be subject to adjustment if the actual nature or quantity of waste differs from that described during the booking process.
3.3 We will confirm acceptance of a booking and provide an indicative arrival window. All booking dates and times are given in good faith but are not guaranteed. We will use reasonable endeavours to attend the Site within the agreed time frame, although delays may occur due to traffic, weather, previous job overruns or other circumstances beyond our control.
3.4 The Customer is responsible for ensuring that a person aged 18 or over is present at the Site at the time of collection to provide access, give instructions, and approve any variations to pricing or scope of work.
4. Access and Customer Obligations
4.1 The Customer must ensure that we have safe, clear and reasonable access to the Site and to the waste requiring collection. Any parking restrictions, loading bays, security gates or entry systems must be disclosed at the time of booking.
4.2 The Customer is responsible for obtaining any necessary permissions, permits or authorisations required to enable us to park or gain access to the Site. This includes any local authority permits for parking where needed. Any fines or penalties incurred due to incorrect or incomplete information provided by the Customer may be charged to the Customer.
4.3 The Customer must ensure that the waste is clearly identified and accessible at the time of collection. Unless otherwise agreed, we are not responsible for dismantling fixtures, disconnecting appliances, or moving items that are not part of the agreed waste.
4.4 The Customer warrants that they either own the waste or have the authority of the owner to request its removal and disposal. The Customer shall indemnify us against any claim by a third party alleging unlawful removal of items.
5. Pricing and Payment Terms
5.1 Our prices are normally based on the type and volume of waste collected, measured by reference to the space taken on our vehicle, together with any additional labour, access difficulty or special handling requirements. Prices may also be affected by the weight, composition and segregation needs of the waste.
5.2 Unless otherwise stated, all prices are quoted exclusive of VAT, which will be added at the prevailing rate where applicable. Any local charges such as tipping fees or specialist recycling fees may be included in the quotation or charged separately as notified to the Customer.
5.3 Payment is due on completion of the Services unless an alternative arrangement has been agreed in writing prior to the collection. We accept payment by cash, debit or credit card, or bank transfer, subject to any payment methods we make available at the time of service.
5.4 For account Customers or regular waste collection contracts, payment terms will be set out in the account agreement or invoice. If payment is not made by the due date, we reserve the right to charge interest on overdue sums at the statutory rate and to suspend further Services until outstanding amounts are cleared.
5.5 If, on arrival, the actual volume or nature of waste materially exceeds that described at the time of booking, we may revise the price and seek the Customer’s approval before proceeding. If agreement cannot be reached, we may cancel the job or limit the collection to the amount covered by the original quotation.
6. Cancellations and Amendments
6.1 The Customer may cancel or reschedule a booking by giving us notice. Where at least 24 hours notice is given, no cancellation fee will normally apply.
6.2 If the Customer cancels or significantly alters a booking less than 24 hours before the agreed attendance window, we may charge a cancellation fee to cover our administrative and scheduling costs, including any travel or staffing costs already incurred.
6.3 Where we arrive at the Site and are unable to carry out the Services due to lack of access, the absence of an authorised person, unsafe conditions, or material misdescription of the waste, this may be treated as a late cancellation. In such circumstances, we may charge a call-out or wasted journey fee.
6.4 We may cancel or postpone a booking where we are unable to carry out the Services due to events beyond our reasonable control, including extreme weather, vehicle breakdown, staff illness, accidents, or compliance with legal or regulatory requirements. In these circumstances, we will seek to rearrange the appointment as soon as reasonably practicable and will not be liable for any loss suffered by the Customer as a result of such delay or cancellation.
7. Waste Regulations and Prohibited Items
7.1 We operate in compliance with applicable UK waste management laws and regulations. All waste collected will be transported and disposed of at authorised facilities, and we will take reasonable steps to maximise reuse and recycling where appropriate.
7.2 The Customer agrees that they will not present for collection any waste that is classified as hazardous or special waste, including but not limited to asbestos, clinical or medical waste, chemicals, flammable liquids, gas cylinders, radioactive materials, or any other substances that we are not licensed or equipped to handle, unless we have specifically agreed in writing to collect such waste and appropriate arrangements have been made.
7.3 If we discover that waste presented for collection contains hazardous or prohibited materials, we may refuse to remove the affected items, or we may make additional charges to deal with them safely and in accordance with the law. The Customer shall remain responsible for any costs, penalties or liabilities arising from the incorrect description, storage or presentation of such waste.
7.4 The Customer is responsible for ensuring that confidential documents or data-bearing items are disposed of securely. Unless we specifically agree to provide a confidential destruction service, we shall not be responsible for any loss or misuse of data contained in items placed in general waste or recycling.
8. Performance of Services
8.1 We will exercise reasonable care and skill in carrying out the Services and will make reasonable efforts to minimise disruption to the Customer and neighbouring properties.
8.2 The Customer acknowledges that minor scuffs, marks or disturbances to surfaces may occur during the removal of bulky or heavy items, especially in confined spaces, stairwells or narrow access routes. The Customer should move or protect any fragile items, floor coverings or decorations that might be susceptible to damage during the collection.
8.3 We may take photographs of the waste and the area before and after the collection for evidential, training and quality control purposes. Such photographs will be used in accordance with applicable data protection laws.
9. Limitation of Liability
9.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
9.2 Subject to the above, our total liability to the Customer arising out of or in connection with the Services, whether in contract, tort, negligence or otherwise, shall be limited to the total amount paid or payable by the Customer for the specific Services giving rise to the claim.
9.3 We shall not be liable for any indirect, consequential, incidental or special loss, or for loss of profit, revenue, business, contracts, goodwill or anticipated savings, arising out of or in connection with the provision of the Services.
9.4 We shall not be liable for any damage to items not clearly identified as waste, unless such damage is caused by our negligence and the items were reasonably protected and located away from the working area. It is the Customer’s responsibility to identify and remove valuables or items not intended for disposal before we commence work.
9.5 We will not be responsible for any delay or failure in performance caused by events beyond our reasonable control, including acts of God, strikes, lockouts, industrial disputes, accidents, adverse weather, traffic conditions, fire, flood, or compliance with any law or governmental order.
10. Customer Indemnity
The Customer shall indemnify and keep us indemnified against all claims, costs, damages, fines, penalties and expenses arising from any breach by the Customer of these Terms and Conditions, including but not limited to misdescription of waste, failure to obtain necessary consents, or presentation of hazardous or prohibited items for collection.
11. Complaints and Disputes
11.1 If the Customer is dissatisfied with any aspect of the Services, they should notify us as soon as possible, ideally within 48 hours of completion, providing details of the issue and any supporting evidence.
11.2 We will investigate complaints in a fair and timely manner and will seek to resolve them by agreement where possible. We may request further information or photographs to assist our investigation.
11.3 If a dispute cannot be resolved by negotiation, either party may pursue its rights through the courts in accordance with the governing law clause below.
12. Privacy and Data Protection
We will process personal data relating to Customers, such as contact details and service history, for the purposes of managing bookings, delivering Services, processing payments and handling enquiries. We will handle such data in accordance with applicable UK data protection legislation and will use reasonable measures to protect it from unauthorised access or disclosure.
13. Variations to Terms
We reserve the right to amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that particular service transaction. Any significant changes may be notified on our service documentation or by direct communication where appropriate.
14. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms and Conditions, together with any written quotation or service confirmation, constitute the entire agreement between the parties in relation to the Services and supersede any prior understandings, statements or representations, whether oral or written, relating to the subject matter.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of waste collection services.
